0422LU – Getting your permit on importing cyberinformation security products within only 05 working days

On 20 July 2022, the Ministry of Information and Communications issued the Circular No. 10/2022/TT-BTTTT amending and supplementing a number of articles of Circular No. 13/2018/TT-BTTTT dated 15 October 2018 providing the list of cyberinformation security products imported under permits and the order, procedures and dossiers for grant of permits for import of cyberinformation security products (“Circular 10“).

Under this Circular 10, all adequate dossiers submitted to the Authority of Information Security – Ministry of Information and Communications (“Authority“), will be settled within 05 working days instead of 07 working days. If the the submitted dossier satisfies all the conditions prescribed in Article 48.3 of the Law on Cyberinformation Security, the Authority shall grant the applicant an import permit. The import permit shall be made in accordance with the Form No. 03 provided in Appendix II of this Circular 10. If the dossier fails to fully satisfy prescribed conditions, the Authority shall issue a written reply clearly stating the reason of refusal to grant a permit.

In addition, for an import permit, which remains valid but lost or damaged, the concerned applicant can send a written request for re-grant of import permit, made according to Form No. 02 provided in Appendix II to this Circular 10, to the Authority . Within 02 working days after receiving a valid request, instead of 03 working days as in previous regulations, the Authority shall re-grant the import permit to the applicant.

Last but not least, under this Circular 10, a copy of the license for dealing in cyberinformation security products and services shall no longer be required in the dossier for grant of permits for import of cyberinformation security products.

This Circular 10 will be effective from 15 September 2022.
